Nurses

Most nurses are entitled to overtime, meal breaks and rest breaks, however, nurses have their own definition of hours worked and may not be entitled to wages for sleep time and other nonproductive time. The following nurses are exempt from overtime:

• Nurses who are subject to a valid Alternative Workweek Schedule have special overtime rules;
• Student nurses in a school accredited by the California Board ofRegistered Nursing or by the Board of Vocational Nurse andPsychiatric Technician Examiners who are subject to Wage Order5 are not entitled to overtime compensation.
• Certified nurse midwives can be exempt professional employees under all IWN Wage Orders.
• Certified nurse anesthetists can be exempt professional employees under all IWN Wage Orders.
• Certified nurse practitioners cab be exempt professional employees under all IWN Wage Orders.
