AMBULANCE DRIVERS AND ATTENDANTS

Ambulance drivers and attendants have special overtime rules.

Rules:
Ambulance drivers and attendants, such as medical technicians or paramedics, who are subject to IWC Wage Order 5 or IWC Wage Order 9 and who work 24 – hour shifts are entitled to overtime, however, they are not entitled to the normal overtime requirement if the employee has agreed, in writing, to exclude from daily time worked not more than three meal periods of not more than one hour each and a regularly scheduled uninterrupted sleeping period of up to eight hours
Rules:
If the above Element is met, employers can pay the employee straight time for 13 hours (i.e. 24 hours – 8 hours of sleep – 3 hours of meal time).

If the sleep time is on call and not scheduled to be uninterrupted, then the employer is not in compliance
Rules:
If employees do not get at least 5 hours of uninterrupted sleep, all sleep time must be counted as hours worked.
Rules:
If the ambulance driver or attendant is a private emergency employee, the employee can be “on – call” during meal and rest breaks.
