DISCRIMINATION AND HARASSMENT
“Discrimination” occurs when an employee or job applicant is treated differently or unfairly due to a personal characteristic, such as, age, sex, race, gender, national origin, religion, pregnancy and childbirth, sexual orientation, physical or mental disability, or medical condition. Since anti-discrimination laws only prohibit discrimination based on a protected class, not every act of discrimination or unfair treatment is against the law.
Harassment occurs when an employee’s supervisor or co-workers says or does something that is based on a personal characteristic or status protected under the anti-discrimination laws and is “severe or pervasive”.
Employers must adhere to specific guidelines such as selecting and interviewing employees, setting work standards, resolving work issues, and termination (firing). In general, all steps of employment, including interviewing, hiring, raises, advertising, and terminating employees are covered by bias laws.
There are several State and Federal Laws that prohibit discrimination and harassment at the jobsite. These laws apply only when the employer has at least a certain number of employees
